ORDINANCE NO. 2063

AN ORDINANCE RELATING TO THE VACATION OF THE STREET KNOWN AS WESTVIEW COURT IN THE CITY OF HIAWATHA, KANSAS, VACATING SAID STREET BEGINNING AT THE
INTERSECTION OF TWELFTH STREET AND WESTVIEW COURT AND EXTENDING WEST TO THE INTERSECTION OF THIRTEENTH STREET AND WESTVIEW COURT, REVERTING THE SAME TO
ADJONING LANDOWNERS ON EACH SIDE IN PROPORTION TO THE FRONTAGE OF SUCH REAL ESTATE; AND RESERVING

UTILITY EASEMENTS OVER AND UNDER SAID VACATED AREA.

WHEREAS, there exists within the City of Hiawatha, Brown County, Kansas, a street known as Westview Court that extends from the intersection of Twelfth Street and Westview Court west to the intersection of Thirteenth Street and Westview Court, more particularly described as follows:

Commencing at the intersection of Twelfth Street and Westview Court and extending west on said street and street right-of-way to the intersection of Thirteenth Street and Westview Court in the City of Hiawatha, Brown County, Kansas; and

WHEREAS, the City Commission of the City of Hiawatha, Kansas, has found it necessary to vacate Westview Court from intersection of Twelfth Street and Westview Court to the intersection of Thirteenth Street and Westview Court, in the City of Hiawatha, Brown County, Kansas; and

WHEREAS, vacation of the street described herein is authorized under K.S.A. 14-423.

WHEREFORE, BE IT ORDAINED by the governing body of the City
Hiawatha, Kansas:

SECTION 1. That the street known as Westview Court and more
particularly described hereinabove is hereby vacated, except the City of Hiawatha, Kansas reserves unto itself any utility easements over and under the above-described street and street right-of-way.

SECTION 2. That the street known as Westview Court and more
particularly described hereinabove shall revert to the owners of the real estate thereto adjacent on each side in proportion to the frontage of said real estate, except and subject to the existing utility easements reserved in Section 1 of this ordinance.

SECTION 3. That this Ordinance shall take effect and be in full force thirty (30) days from and after publication in the official city newspaper unless protest is made in writing to the City Clerk.

SECTION 4. That immediately after this ordinance becomes effective, the Clerk of the City of Hiawatha, Kansas shall file a copy of this vacating Ordinance, which has been certified by the Clerk as a true and correct copy, with the Clerk of Brown County, Kansas, and the Register of Deeds of Brown County, Kansas.
