RESOLUTION NO. 2019-1
A RESOLUTION FIXING A TIME AND PLACE FOR A HEARING ON A PETITION ALLEGING A VIOLATION OF K.S.A. 12-1750 ET. SEQ. AS ADOPTED BY ORDINANCE #82 OF THE CITY OF HAMLIN, KANSAS, AND SEEKING ABATEMENT OF SAID VIOLATIONS IN ACCORDANCE WITH SAID STATUTES AND ORDINANCE.

WHEREAS, the public officer of the City of Hamlin has determined upon his own motion that conditions exist on the real estate hereinafter described which constitute a violation of K.S.A. 12-1752, which has been incorporated as City Code by Ordinance #82; and,

WHEREAS, the public officer has made a report of such findings to the City Council after sending written notice to the owner to abate said violations, which violations still exist even though the time set for remedying the violations has lapsed; and,

WHEREAS, by reason of the foregoing, it is necessary to pass a resolution fixing the time and place of a hearing at which the City Council shall determine whether or not to abate said violations;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMLIN, KANSAS, as follows:

1. A hearing shall be held to determine whether the conditions located upon the following described real estate, in the City of Hamlin, Brown County, Kansas, to wit:

Lots 2, 4, & 6, North of Leonard St., in the City of Hamlin, Brown County, Kansas, commonly known as 304 First St., Hamlin, Kansas;

violate K.S.A. 12-1752 as adopted by Ordinance #82, by allowing conditions to exist which are injurious to the health, safety and general welfare of the residents of the community and which are detrimental to adjoining property, the neighborhood, and the City, as alleged by the public officer of the City of Hamlin, is hereby fixed to be heard on the 14th day of January, 2020 at 7:30 o'clock p.m., in the City Hall, Hamlin, Kansas.

2. The owners of said property, either personally or by agent, any lien holder of record, or any occupant of the structures located thereon may appear and show cause why the conditions should not be abated by the City and costs thereof.

3. Failure to appear and show cause, if any, may result in the City Council's finding that violation(s) have occurred and that said violation(s) should be abated and the costs of said abatement assessed against the property.

4. This Resolution shall be published in the official city newspaper once each week for two weeks.

PASSED AND ADOPTED BY THE CITY COUNCIL AND APROVED BY THE MAYOR OF THE CITY OF HAMLIN, KANSAS, this 12th day of November, 2019.
